9. Dispute Resolution and Arbitration

Agreement to Arbitrate: You and Trucking Advisor agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved exclusively through binding individual arbitration, rather than in court, except as set forth below.
Arbitration Rules: Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this Agreement. The arbitration shall take place in Texas, or at another mutually agreed location.
Exceptions: Either party may bring an individual claim in small claims court if the claim qualifies. Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Class Action Waiver: YOU AND TRUCKING ADVISOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
Opt-Out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@truckingadvisor.com with the subject line "Arbitration Opt-Out."
10. Indemnification
You agree to indemnify and hold harmless Trucking Advisor from any claims, damages, or expenses resulting from your use of the Site or violation of these Terms.
11. Termination
We reserve the right to suspend or terminate access to the Site at any time, without notice, for any reason.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. To the extent any dispute is not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts located in Texas.
13. Changes to Terms
We may update these Terms at any time, and continued use of the Site constitutes acceptance of any changes.
